Terms of Use

These Terms of Use ("Terms") govern your access to and use of the websites avbrlab.org and polinahneletska.com (together, the "Sites"), operated by American Visual & Behavioral Research Lab Inc. ("AVBR Lab", "we", "us"), a California nonprofit public benefit corporation. By using the Sites, you agree to these Terms.

1. Purpose of the Sites

The Sites present the research program, methods, findings, and publications of AVBR Lab, and the professional profile of its Research Director. The Sites are informational; nothing on them constitutes commercial, legal, financial, or investment advice.

2. Research disclaimer

Our findings describe aggregate statistical patterns observed across samples of publicly accessible online storefronts at specific points in time. They are not statements about the intent or conduct of any individual merchant, store, or platform, and do not allege wrongdoing by any specific party. Store-level data in our public datasets is anonymized. AVBR Lab is independent and is not affiliated with, endorsed by, or sponsored by Shopify Inc., BigCommerce Pty. Ltd., or any other platform or merchant named in our research; platform names are used solely to identify the subject of study. Research results are provided “as is”, may contain errors inherent to external (black-box) measurement, and may change as methods improve; known limitations and capture losses are disclosed in our methodological materials.

3. Intellectual property and licenses

(a) The audit protocol, codebooks, and metric definitions published in our public repositories are licensed under Creative Commons Attribution 4.0 International (CC BY 4.0) — you may share and adapt them with attribution to AVBR Lab.

(b) Public datasets are released under the license stated in each deposit record (Zenodo).

(c) All other content of the Sites (texts, graphics, logo, design) is © American Visual & Behavioral Research Lab Inc. or its licensors. You may quote brief excerpts with attribution and a link; any other reproduction requires our written permission ([email protected]).

(d) “AVBR Lab” and the shelf mark are identifiers of our organization; do not use them in a way that suggests affiliation or endorsement.

4. Acceptable use

You agree not to misrepresent our findings, present modified figures as ours, scrape the Sites in a manner that disrupts them, or use the Sites for unlawful purposes.

The Sites link to third-party resources (GitHub, Zenodo, LinkedIn, journals). We are not responsible for their content or practices.

6. No warranties; limitation of liability

The Sites and their content are provided “as is” and “as available”, without warranties of any kind, express or implied. To the maximum extent permitted by law, AVBR Lab shall not be liable for any indirect, incidental, consequential, or special damages arising from use of the Sites or reliance on their content. Where liability cannot be excluded, it is limited to the amount permitted by applicable law.

7. Corrections

We take accuracy seriously. If you believe any statement on the Sites is inaccurate, contact [email protected]; substantiated corrections are reflected with a note in the relevant material.

8. Changes

We may update these Terms; the effective date above will change accordingly. Continued use after changes constitutes acceptance.

9. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Venue for disputes lies in the state or federal courts located in California.
